Welcome to Elle Office Design Studio (“Elle Office,” “Company,” “we,” “our,” or “us”). By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions (“Terms”). Please read them carefully.

1. Services
We offer web design, branding, social media management and related services. The specifics of each service will be outlined in a separate proposal or contract (Project Agreement/Quote/Invoice) tailored to your individual needs.

2. Acceptance of Terms
By accessing our website or using our services, you acknowledge that you have read, understood, and agreed to these Terms. Payment of the project fee or retainer fee indicates acceptance of the quote, these Terms, and any verbally or written agreed-upon details discussed during consultations.

3. Changes to Terms
We reserve the right to modify these Terms at any time without prior notice. Any changes will be effective upon posting on our website. Continued use of the website or our services following the posting of changes constitutes your acceptance of such changes. We will always do our best to notify you in the event of a change we believe you will be affected by.

4. Client Responsibilities
You agree to provide timely feedback, materials, and information necessary for us to complete the project.
You acknowledge that delays in providing requested materials may result in project delays.
You agree that all intellectual property provided by you for the project is either owned by you or you have the necessary permissions to use it.

5. Payment of Fees

All services are provided based on the pricing outlined in the Project Agreement/Quote/Invoice. Payment schedules are also detailed in the Project Agreement/Quote/Invoice. Payment of the project fee or retainer fee signifies your acceptance of both the quote and these Terms of Service. Late payments may incur a fee, and we reserve the right to suspend or terminate work until payment is received.

6. Refund Policy
Refunds of the initial amount, retainer fee, or deposit are not provided, as by committing to your project, we forfeit the time and opportunity to take on other projects.

If your project deadlines or goals change, we will make efforts to accommodate these changes, ensuring that your project is not disadvantaged.
Should you decide to cancel your project, the remaining amount on your quote (total fee) will be due if 50% or more of the project scope has already been completed.

You agree to these Terms upon accepting your initial quote and making payment of your retainer or initial fee.

7. Revisions and Approvals
We offer reasonable, ongoing revisions as part of our service. Additional revisions may be subject to extra charges. Once the project is completed and approved by you, any further changes will be considered new work and billed accordingly.

8. Intellectual Property
All work created by us during the project remains the intellectual property of Elle Office Design Studio until full payment has been made.
Upon receipt of full payment, ownership of the final work will transfer to you, excluding any third-party elements or stock content used.
We reserve the right to showcase your project as part of our portfolio unless otherwise agreed upon in writing.

9. Project Timeline
The timeline for each project will be outlined in the Project Agreement/Quote/Invoice. While we make every effort to meet deadlines, we cannot be held responsible for delays caused by factors outside our control, such as your failure to provide timely feedback or materials.

10. Confidentiality
Both parties agree to keep confidential any proprietary, personal, or project-related information shared during the course of the project.
Any information or materials provided by either party will remain undisclosed to third parties unless explicit written consent is given.
Elle Office will not share, disclose, or use any client information, including project details, designs, or strategies, without the client’s consent, except where legally required.
Any agreement to showcase elements of the project (e.g., as part of our portfolio) will be discussed and agreed upon before any information is made public.

11. Kindness and Mutual Respect
At Elle Office Design Studio, kindness is the cornerstone of our approach to collaboration and creativity. We believe that a foundation built on kindness fosters a productive and enjoyable working relationship, enabling both parties to achieve their goals more effectively.

Both parties agree to maintain a professional, respectful, and kind demeanour throughout the project. This commitment to kindness extends to all forms of communication, whether verbal, written, or digital. We encourage open dialogue and constructive feedback, recognizing that each interaction is an opportunity to build trust and understanding.

We believe that a positive working relationship is key to delivering successful results, and any form of disrespectful or inappropriate behaviour will not be tolerated. Should either party fail to uphold this standard, it may result in the termination of the project without liability for either party.

12. Termination of Services
In the event that your project is delayed or cancelled, you will be invoiced for any completed work up to the termination date. If 50% or more of the project scope has been completed you will be liable for the full outstanding amount.

13. Disclaimers and Limitation of Liability
We make no guarantees regarding the success of your website or brand after the services have been completed.
In no event shall Elle Office Design Studio be liable for any indirect, special, or consequential damages arising out of the use or inability to use the services or website.
